Pharmaceuticals Conspiracy: Defence Vindicated
At the Court of Appeal on the 3rd December 2008 the final nail was driven into the coffin of a misconceived political prosecution brought by the Serious Fraud Office.
Denis O'Neill was the principal human defendant in a 10 year investigation and prosecution brought by the SFO. It was alleged that he was the architect of a conspiracy to defraud the Department of Health by increasing the price of generic drugs.
His case was that the actions taken were taken in order to enable the introduction of patient packs which were necessary to comply with European legislation. The Labour Government had agreed to fund this, but walked away from it in breach of their responsibilities under the legislation.
The House of Lords, in January, held that the SFO's allegations did not constitute a criminal offence. This should not have come as a surprise to the SFO since Lesley Burrows, the solicitor for O'Neill, told the SFO investigators at the first interview that what they were alleging did not constitute an offence.
Commenting today, Ms. Burrows of Burrows Bussin Solicitors, said, "It is extremely unfortunate that what appeared to the Defence to be obvious in 2005 has taken 3 years for the SFO to understand. In the meanwhile, my client has had years of anguish and a huge amount of public money has been wasted on a misconceived prosecution. It is unfortunate that the Director of the SFO did not realise the futility of pursuing an appeal before it had to be pointed out to him by the Court of Appeal."
