Recent changes in legislation have dramatically altered the Competition Law landscape. With the Competition Act 1998, which prohibited anti-competitive behaviour and the Enterprise Act 2002, which introduced new criminal penalties for cartel activity, the remit of the OFT and the SFO has been considerably widened.

The powers of prosecuting authorities have been extended to an unprecedented level with the use of US style whistle-blower provisions and Accomplice Witness Schemes. Such controversial measures require witness material to be approached with extreme caution and powerful scrutiny to prevent injustice from occurring.

We are at the forefront of this fast evolving area of the law and are currently representing the first defendant in the largest and most complex prosecution ever brought by the SFO, concerning price-fixing within the generic drugs industry.
